Car Accident Litigation and Modern Technology

These days, a lot of people have cellphones that can take pictures.  Those cellphones can assist you should a car accident turn into litigation.  There are some things that you can do if you are hit by an at fault driver that will assist your attorney in settlement discussions or at trial if necessary.

Take close-up photos of the damage to your car.  Also, step back and take photos of the damaged areas including the surroundings.  This gives a perspective for the extent of damage and the degree of impact.  This can tie in to the seriousness of an injury you have received in a car accident.

Walk down the road and take pictures of the road conditions and the orientation of the crash vehicles.  This can help with showing fault.  Take photos of the extent of debris, tire and skid marks, and the like.  This can be useful at trial, or in the process of persuading an insurance company that your settlement proposal is a good one.

Be sure to take a picture of the license plates of the offending vehicle.  Also, try to include broken pieces and debris from the accident in your photographs.

Take pictures of bruises on your body or those on the bodies of your passengers.  Take pictures of the inside of the vehicle, to show where the points of impact have occurred.  Take pictures of the airbags that have inflated.

If you are not in a position or are physically incapable of doing these things, ask an uninjured passenger to take pictures for you.

Be sure to take care of yourself and injured persons first.  Be sure that you are not placing yourself in jeopardy when positioning yourself to take photographs.  Call emergency 911 first if anyone has been hurt.

Your cellphone can be a powerful weapon in any insurance dispute or litigation.
